Filing for an Uncontested Divorce
At the time you file for a Texas divorce, you as the petitioner or the respondent (your ex) must have resided in Texas for the preceding six (6) month period and be a resident of the county you're filing in for the last ninety (90) day period. Should you be filing for a No-Fault divorce you have to either:
a) present the basis as to why you're terminating the marriage. In plain language, you need to describe in a written document that the marriage is no longer sustainable due to personal incompatibility and furthermore it is not reasonable to believe that the marriage can be reconciled. b) Indicate on your filing that you and your ex have lived separately for the last 3 months and that there has been no cohabitation.
Uncontested divorces are usually handled by divorce lawyers, and the fees charged by the divorce attorneyare much lower than for a contested divorce cases.
