The Uncontested Divorce Process
The divorce process in Texas begins as soon as the petitioner has the
respondent served with the Original Petition for Divorce along with a Notice of
Service. The petition and service are in most cases served by the Sheriff, a
Constable or process service corporation. The Notice informs the respondent he
or she has 20 days plus the following Monday to respond to the Petition. The
respondent may choose to waive service in writing or make a decision to not file
any answer in which instance following the 60 day waiting period, the Court will
issue a final legal order granting the divorce. The cost of filing for the
Original Petition, Citation and Service of Process vary slightly from location
to location, but if you need to process all three documents, it may run more
than $300. Usually, the paper work will be handled by a divorce lawyer, and the
attorney fees for the divorce are a lot smaller than in a contested divorce
cases
